Privacy and Terms Agreement

1. Introduction
This agreement explains how Movement Management UK Ltd ("the Agency", "we", "us", "our") collects, uses, stores, and protects the personal data of athletes ("the Athlete", "you", "your"). It also outlines key terms relating to your representation by the Agency.
The Agency is registered with the Information Commissioner's Office (ICO) and complies fully with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
By signing this agreement, you confirm that you have read and understood these terms and consent to the collection and processing of your data as described below.
2. Data We Collect
In connection with your representation, we may collect and process the following categories of personal data:
- Personal Information: Full name, date of birth, contact details (address, phone, email), emergency contact details, nationality, and passport or identification details where required for travel or work permits.
- Professional Information: Showreel and performance footage, photographs, CV, skills profile, training history, professional qualifications, and publicly available social media content relevant to your profile.
- Financial Information: Bank details, tax reference number, invoicing records, and payment history, collected solely for the purpose of processing payments owed to you.
- Health Information: Relevant medical conditions, injuries, or physical limitations, collected only with your explicit consent and only where necessary for your safety on a specific engagement.
3. Legal Basis for Processing
We process your data under one or more of the following legal bases:
- Contractual Necessity: Processing is necessary to perform our obligations under your representation agreement.
- Legitimate Interest: Processing is necessary for the legitimate interests of the Agency, provided those interests do not override your fundamental rights.
- Consent: Where we process sensitive data or use your data beyond the scope of your representation agreement, we will obtain your explicit, informed consent. You may withdraw consent at any time.
4. How We Use Your Data
- Representation and Promotion: Presenting your profile to potential clients, production companies, brands, and event organisers.
- Securing and Managing Work: Negotiating contracts, coordinating logistics, and managing schedules.
- Payments: Processing commission payments, invoicing, and maintaining financial records as required by law.
- Safety and Compliance: Sharing relevant health information with clients where necessary for your safety, with your prior consent.
- Website and Marketing: Displaying your name, photograph, biography, and showreel on the Agency's website and social media channels.
5. Data Sharing
We may share your data with clients, production companies, event organisers, accountants, legal advisers, and regulatory bodies where necessary. We will never sell your personal data to third parties.
Where data is transferred outside the United Kingdom, we will ensure appropriate safeguards are in place in accordance with UK GDPR.
6. Promotional Use of Your Image
You grant the Agency a non-exclusive, royalty-free licence to use your name, likeness, photographs, and performance footage for promoting your profile and the Agency's services. This does not extend to third-party endorsement without your written consent. You may request removal of specific materials at any time.
7. Data Retention
We retain your data for the duration of your representation and for six (6) years following termination, to comply with legal and regulatory obligations. Health data will be deleted within 12 months of the relevant engagement concluding.
8. Your Rights
Under UK GDPR, you have the right to:
- Access the personal data we hold about you
- Rectify any inaccurate or incomplete data
- Erase your data where there is no compelling reason for continued processing
- Restrict processing in certain circumstances
- Port your data in a structured, commonly used format
- Object to processing based on legitimate interest
- Withdraw consent at any time where processing is based on consent
To exercise these rights, contact us below. We will respond within one calendar month. You may also lodge a complaint with the ICO at ico.org.uk.
9. Data Security
We implement appropriate technical and organisational measures to protect your data against unauthorised access, alteration, disclosure, or destruction.
10. Changes to This Agreement
We may update this agreement from time to time. Where changes are material, we will notify you in writing.
